By accessing or using the blackhawnketwork platform, API, or any related services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use our services.
blackhawnketwork provides a gift card and incentive payment API platform that enables businesses to programmatically issue, manage, and redeem digital gift cards and incentive instruments. The service is provided on an 'as-is' basis subject to these terms, and we reserve the right to modify or discontinue features with reasonable notice.
You must register for an account to access the API. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify us immediately at [email protected] if you suspect unauthorized access to your account.
All API usage fees are billed according to the plan you select at registration or as agreed in a separate order form. Fees are non-refundable except where expressly stated. We reserve the right to suspend access for overdue balances exceeding 30 days.
Gift cards and incentive instruments issued through the platform are subject to the terms of the underlying card program and applicable law. blackhawnketwork acts as a technology intermediary and is not the card issuer unless expressly stated. Unused balances and expiry policies are governed by the relevant card program terms.
All software, documentation, APIs, and content provided by blackhawnketwork are the exclusive property of blackhawnketwork or its licensors and are protected by intellectual property law. You are granted a limited, non-exclusive, non-transferable license to use the API solely for your authorized business purposes.
You may not use the service for any unlawful purpose, including money laundering, fraud, or the circumvention of financial regulations. You may not reverse-engineer, resell, or sublicense the API without express written consent. Violation of these restrictions may result in immediate account termination and legal action.
Your use of the platform is also governed by our Privacy Policy, available at blackhawnketwork.com. We process personal data in accordance with applicable data protection laws, including GDPR where applicable. You are responsible for obtaining any necessary consents from your end users.
The service is provided 'as is' and 'as available' without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components. Your use of the service is at your own risk.
To the maximum extent permitted by law, blackhawnketwork's total aggregate liability for any claim arising out of or relating to these terms shall not exceed the fees paid by you in the three months preceding the event giving rise to the claim. In no event shall we be liable for indirect, incidental, consequential, or punitive damages.
Either party may terminate these terms at any time with 30 days written notice. We may terminate or suspend your access immediately and without notice for material breach of these terms. Upon termination, your license to use the API ceases and any outstanding fees become immediately due.
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the state or federal courts located in Wilmington, Delaware.
We may update these Terms of Service from time to time and will notify registered users via email or an in-platform notice at least 14 days before material changes take effect. Continued use of the service after the effective date constitutes acceptance of the revised terms.
